Terms & Conditions
- Information on how to enter and the prizes form part of these Terms and Conditions. The entrant agrees and acknowledges that they have read these Terms and Conditions (including the Schedule) and that entry in this Promotion is deemed acceptance of these Terms and Conditions (including the Schedule). Any capitalised terms used have the meaning given in the Terms and Conditions or Schedule, unless stated otherwise. These terms and conditions will be posted on the Scarborough Wine Co. website for the duration of the competition.
Eligibility
- Entry is open to all Australian residents who live in NSW, VIC, QLD, NT, WA, TAS aged 18 years and over as at the Start Date of the Promotion, and who are members of the Scarborough Wine Club at the time of entry.
- The following are ineligible to participate in the Promotion: directors, officers and employees (and their immediate families) of the Promoter or its related entities; Immediate family means any of the following: spouse, ex-spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.
- One scratch card will be included with each eligible Wine Club dispatch. Scratch cards are pre‑printed with randomly assigned instant win prizes.
- This Promotion is a game of chance. The type of instant win prize awarded to each entrant is determined randomly.
Promotion Period
- The Promotion commences on the Start Date and ends on the End Date.
- Redemption of the Prizes will be accepted during the Promotional Period. No late Redemptions will be accepted. Prizes must be redeemed by the date listed in the Promotion Schedule, regardless of when the scratch card is opened.
Prizes
- Each prize will be awarded to the person in receipt of the instant win prize. If there is a dispute as to the identity of an entrant or winner, the Promoter reserves the right, in its sole discretion, to determine the identity of the entrant or winner.
- Scratch cards form part of the advertising material for this Promotion. The NSW Authority Number will be printed on all scratch cards and promotional materials as required by law.
- Each Prize validity date is listed in the Promotion Schedule and the prize must be redeemed by the listed date.
- If any winner chooses not to take their Prize (or is unable to), loses their Prize or does not take or claim a prize by the time specified by the Promoter (as displayed in the Promotion Schedule), they forfeit the Prize, and the Promoter is not obliged to substitute the prize.
- The value of the Prize is accurate and based upon the recommended retail value of the Prize (inclusive of GST) at the date of printing. The Promoter accepts no responsibility for any variation in the value of the Prize after that date.
- No part of a Prize is exchangeable for other goods, subject to substitutions, redeemable for cash or any other prize or transferable. If a Prize (or portion of a prize) is unavailable the Promoter reserves the right to substitute the Prize (or that portion of the Prize) to a prize of equal or greater value and specification.
- The maximum Prize per person will be capped at one (1).
- Any cost associated with Prize redemption is the entrant’s responsibility.
Conduct of Promotion
- The Promoter reserves the right to disqualify entries in the event of non-compliance with these Terms and Conditions. If there is a dispute concerning the conduct of the Promotion or claiming a prize, the Promoter will resolve the dispute in direct consultation with the entrant. If the dispute cannot be resolved the Promoter’s decision will be final.
- If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in their sole discretion, to the fullest extent permitted by law to disqualify any entrant or modify, suspend, terminate or cancel the Promotion, as appropriate.
- The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and/or wine club membership status) and reserves the right, in its sole discretion, to disqualify any entrant who the Promoter has reason to believe has breached any of these Terms and Conditions, or engaged in any unlawful, improper or inappropriate conduct. Errors and omissions may be accepted at the Promoter’s discretion.
- The Promoter accepts no responsibility for any late, lost, delayed, incomplete, incorrectly submitted, corrupted, illegible or misdirected claims or correspondence whether due to omission, error, alteration, tampering, deletion, theft, destruction, disruption to any communication network or medium, or otherwise including those entries not received by the Promoter for any reason. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred. No correspondence will be entered into.
- The Promoter and its related entities will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence or willful misconduct) in connection with this Promotion or accepting or using any prize (or recommendation), except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
- By entering the Promotion, an entrant releases and indemnifies the Promoter and its related bodies corporate (including the officers, employees of each) from and against all actions, penalties, liabilities, claims or demands the entrant may have against the Promoter or that the Promoter may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of an entrant entering or participating in the Promotion or winning a prize, or using or permitting any other person to claim or use a prize, except for any liability which cannot be excluded by law or which would cause any part of this clause to be void or unenforceable.
- Any Prizes that remain unclaimed at the Promotion End Date will become null and void.
Use of Personal Information
- In entering the Promotion, entrants consent to the Promoter using the personal information provided and collected in connection with this Promotion for the purposes of facilitating the conduct of the Promotion and awarding any prizes, including to third parties involved in the promotion and any relevant authorities. The Promoter may use this information for future marketing purposes regarding its products, including contacting the entrant electronically where consent by the entrant has been obtained. If the entrant does not provide their personal information as requested, they may be ineligible to enter or claim a prize in the Promotion.
- The Promoter’s Privacy Policy contains information about how the entrant may access, update and seek correction of the personal information the Promoter holds about them and how the entrant may complain about any potential breach by the Promoter of any privacy laws and how such complaints will be dealt with.
General
- Facebook or Instagram may be used to advertise or promote the Promotion. By entering the Promotion, entrants agree that the Promotion is in no way sponsored, endorsed or administered by, or associated with any such social media platform; and to release such social media platforms from all liability in relation to this Promotion. Any questions, comments or complaints regarding the Promotion should be directed to the Promoter and the relevant social media platform.
- Any guarantee or warranty given is in addition to any relevant statutory guarantees and warranties and nothing in these Conditions of Entry restricts, excludes or modifies or purports to restrict, exclude or modify any statutory consumer rights under any applicable law including the Australian Consumer Law.
- The Promotion and these Terms and Conditions will be governed by the law of New South Wales. Entrants accept the non-exclusive jurisdiction of courts and tribunals of New South Wales in connection with disputes concerning the Promotion.
